Content Creating Academy, LLC
1. Introduction
These Terms and Conditions ("Terms") govern the relationship between Content Creating Academy, LLC ("Content Creating Academy") and its clients ("Client") for services related to “The Virtual Hive” which includes social media support, content generation, video editing, the design of websites, landing pages, funnels, email/text/other follow-ups, admin support as well as hosting, technical support, and the BizGreenhouse CRM Software ("Services").
2. Services
Content Creating Academy agrees to provide the following Services to the Client depending on the level of services ordered:
Establish social media presence
Content Generation
Video Editing
Engagement and Community Management
Content Posting
Analytics and Reporting
Lead Generation
Email and Inbox Management
Weekly One-on-one status update meetings
Social media profile optimization
Miscellaneous Admin support services (as needed)
Sales Funnel Design
Hosting
Technical Support
Ongoing Support
3. BizGreenhouse Software
As part of the Services, the Client may receive a subscription to BizGreenhouse Software included at no extra cost. Once the term of The Virtual Hive is completed, the Client's BizGreenhouse Software subscription will automatically renew at a monthly recurring fee of $97 for hosting and CRM (Customer Relationship Management) software.
Client may upgrade or cancel their BizGreenhouse Software subscription at any time by visiting BizGreenhouse.com and reviewing the current rates or by contacting Content Creating Academy.
The monthly recurring fee of $97 does not include email and text messaging rates. The current rates are as follows
4. Website and/or Funnel Functionality and Accessibility
Please note that the Client's website can only be functional and accessible on the world wide web if the BizGreenhouse account is active and in good standing. If the Client's BizGreenhouse Software subscription is not in good standing, their website may be unavailable or experience other technical issues.
5. Client Responsibilities
The Client agrees to provide the following:
Pre-Launch Strategy Session: The Client must attend the Pre-Launch Strategy Session for onboarding and transfer of information requested.
Request for Information: The Client will provide Content Creating Academy with all necessary items listed in the Request for Information.
Feedback: The Client will provide timely feedback to Content Creating Academy throughout the term of services.
Payment: The Client will pay Content Creating Academy according to the agreed-upon payment terms.
6. No Refunds Policy
Due to the nature of the Services, Content Creating Academy does not offer refunds. However, we are committed to working with the Client until they are satisfied with the design.
7. Assured Customer Satisfaction
We understand that website and funnel design is an iterative process. We will continue working with you until you are happy with the design and functionality. We will provide you with unlimited revisions and support until you are satisfied with the final product.
8. Warranties and Limitations of Liability
Content Creating Academy warrants that the Services will be performed in a professional and workmanlike manner. However, Content Creating Academy does not guarantee specific results or outcomes. Content Creating Academy's liability for any damages arising from the Services is limited to the amount paid by the Client for the Services.
9. Intellectual Property
Content Creating Academy will retain ownership of all intellectual property rights in the designs, graphics, and content created for the Client. The Client will receive a non-exclusive license to use the designs, graphics, and content for the purposes of the website and funnels.
10. Termination
Either party may terminate this Agreement upon written notice to the other party. Upon termination, the Client will pay Content Creating Academy for all Services performed up to the date of termination.
11. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland.
13. Severability
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck from this Agreement, and the remaining provisions shall remain in full force and effect.
14. Waiver
No waiver of any provision of this Agreement shall be effective unless in writing and signed by both parties.
15. Notices
All notices and other communications hereunder shall be in writing and shall be deemed to have been duly given when delivered in person, upon the first business day following deposit in the United States mail, postage prepaid, certified or registered, return receipt requested, addressed as follows:

16. Counterparts
This Agreement may be executed in one or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.
17. Prevailing Party
In the event of any dispute arising out of or relating to these Terms, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs from the non-prevailing party.
Purchase of The Virtual Hive signifies Client has read and accepted the terms of this agreement.
